Mobile application end-user licence agreement
Please read carefully before using the App(s). These terms and conditions were last updated on 1 October 2021.
This end-user licence agreement (EULA) is a legal agreement between you (End-user or you) and the Department of Health and Social Care of 39 Victoria Street, London, SW1H 0EU, United Kingdom
(we, us, our or DHSC) for:
- The Better Health mobile application software and the associated media (Better Health App(s)); collectively referred to as App(s); and
- Associated online or electronic documents (Documents).
We license the use of the App(s) and Documents to you on the basis of this EULA and any rules or policies ("App Store Rules") imposed by the app store provider or operator from whose site the End-user downloaded the App. These rules can be found at https://play.google.com/store/apps and https://itunes.apple.com/gb/genre/ios/id36 (Appstore). We do not sell the App(s) or Documents to you.
We remain the owners of the App(s) and Documents at all times.
Operating system requirements
Certain App(s) may require an Apple or Android Device (as defined in condition 1.4 below) with a camera with auto-focus, internet access and a minimum of 48MB of memory available. The minimum operating systems we support are iOS 10 and Android 6 and above. The App(s) may work on other Operating Systems but the Operating Systems specified above are the minimum Operating Systems we test on and guarantee that the App(s) will run for.
Food Scanner specific
iOS 12.2 and Android 5.1. The App(s) may work on other Operating Systems but the Operating Systems specified above are the minimum Operating Systems we test on and guarantee that the App(s) will run for.
Certain features within the NHS Food Scanner App require more up to date operating systems to be able to run as expected.
The Augmented Reality (AR) feature within the product reveal screen/ badges requires different specifications to execute.
To view AR you will need:
- iOS 12.2+
- Android 7+
*These are both device dependent; to find out if your device supports ARCore, please see the ARCore supported devices documentation.
The App is built with ARCore support, however the requirement for this will be disabled, meaning users with devices which are not on the ARCore support list should still work but without the AR feature of the App.
Important notice
By downloading the App(s) or clicking on the "accept" button below you agree to the terms of this EULA which will bind you. The terms of this EULA include, in particular, the privacy policy defined in condition 1.5 and limitations on liability in condition 6.
If you do not agree to the terms of this EULA, we will not license the App(s) and Documents to you and you must stop the downloading process now. In this case the downloading process will terminate.
You should print a copy of this EULA for future reference.
Agreed terms
1. Acknowledgements
1.1
The terms of this EULA apply to the App(s) or any of the services accessible through the App(s) (Service(s)), including any updates or supplements to the App(s) or any Service(s), unless they come with separate terms, in which case those terms apply. If any open-source software is included in the App(s) or any Service(s), the terms of an open-source licence may override some of the terms of this EULA.
1.2
We may change these terms at any time, notifying you of a change when you next start the App(s). The new terms may be displayed on-screen and you may be required to read and accept them to continue your use of the Service(s).

From time to time updates to the App(s) may be issued through the Appstore. Depending on the update, you may not be able to use the Services until you have downloaded or streamed the latest version of the App(s) and accepted any new terms.
1.4
You will be assumed to have obtained permission from the owners of the mobile telephone or handheld devices that are controlled, but not owned, by you and described in condition 2.2(a) (Devices) and to download or stream a copy of the App(s) onto the Devices. You and they may be charged by your and their service providers for internet access on the Devices. You should check with your mobile or internet service provider for details of data and internet usage charges. You accept responsibility in accordance with the terms of this EULA for the use of the App(s) or any Service(s) on or in relation to any Device, whether or not it is owned by you.

The terms of our privacy policy from time to time (Privacy Policy), available at https://babyworld.world/better-health/privacy-policy/%3C/a%3E for the Better Health App(s) are incorporated into this EULA by reference and apply to those Services that are not specified in condition 1.1 as having separate privacy policies. Additionally, by using the App(s) or any Service(s), you acknowledge and agree that internet transmissions are never completely private or secure. You understand that any message or information you send using the App(s) or any Service(s) may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.

3. Licence restrictions
Except as expressly set out in this EULA or as permitted by any local law, you agree:
- (i) is used only for the purpose of achieving inter-operability of the App(s) with another software program;
- (ii) is not unnecessarily disclosed or communicated without our prior written consent to any third party; and
- (iii) is not used to create any software that is substantially similar to the App(s);

There is no completely safe level of drinking, but the UK Chief Medical Officers' advise that:
- (a) the risk of developing a range of health problems (including cancers of the mouth, throat and breast) increases the more you drink on a regular basis and to keep health risks from alcohol to a low level it is safest not to drink more than 14 units per week on a regular basis.
- (b) if you regularly drink as much as 14 units per week, it is best to spread your drinking evenly over 3 or more days. If you regularly have one or two heavy drinking episodes in a week, you increase your risks of death from long term illness and from accidents and injuries.
- (c) if you wish to cut down the amount you drink, a good way to help achieve this is to have several drink-free days each week.

(c) If you are accessing the App as a member of the public you acknowledge that the data you see within the App is provided to us by our Data Suppliers. If you notice that the App does not display the information you see on the product label, we understand that you may not know who the relevant Data Supplier is for that particular product. Please take a photo of the product (including traffic lights, ingredients list and the front of pack label) and e-mail it to us at betterhealth@dhsc.gov.uk. We will then send it on to the relevant Data Supplier.

Weight Loss Plan

You acknowledge that all information provided, whether originating from us or a third party, may have been compiled based on the nutrient information panel or other relevant information. We do not warrant that any such information is true or accurate and we exclude all liability in respect of the accuracy, completeness, fitness for purpose or legality of that information.

You acknowledge that when using the App(s), if appropriate, the functionality of the App(s) may show the amount of sugar, saturated fat and salt in the product, as part of the information referred to in condition 6.10. The weight of a sugar cube is calculated at four grams, a saturated fat lump at one gram and a salt sachet at 0.5 grams and the illustrations in the App(s) are a visual representation only.

Limitations of Body Mass Index (BMI) measurement:
(a) Your BMI can indicate if you're carrying too much weight but it cannot tell if you're carrying too much fat;
(b) BMI cannot tell the difference between excess fat, muscle or bone;
(c) Adult BMI does not take into account age, gender or muscle mass.This means:
(i) very muscular adults and athletes may be classed "overweight" or "obese" even though their body fat is low;
adults who lose muscle as they get older may fall into the "healthy weight" range even though they may be carrying excess fat;
(d) Pregnancy will also affect a woman's BMI result. The BMI of pregnant women will go up as their weight increases. If you are pregnant, you should use your pre-pregnancy weight when calculating your BMI;
(e) Eating disorders: If you have an eating disorder, the BMI calculator results do not apply. Please do seek further advice from a GP.
7. Termination
7.1
We may terminate this EULA immediately by written notice to you:
(a) if you commit a material or persistent breach of this EULA which you fail to remedy (if remediable) within 14 days after the service of written notice requiring you to do so; or
(b) if you breach any of the Licence Restrictions or the Acceptable Use Restrictions.
7.2 On termination for any reason:
(a) all rights granted to you under this EULA shall cease;
(b) you must immediately cease all activities authorised by this EULA, including your use of any Service(s); and
(c) you must immediately delete or remove the App(s) from all Devices, and immediately destroy all copies of the App(s) and Documents then in your possession, custody or control and certify to us that you have done so.
8. Communication between us
8.1
If you wish to contact us in writing, or if any condition in this EULA requires you to give us notice in writing, you can send this to us by e-mail or by prepaid post to DHSC at 39 Victoria Street, London, SW1H 0EU, United Kingdom and betterhealth@dhsc.gov.uk. We will confirm receipt of this by contacting you in writing, normally by e-mail.
8.2
If we have to contact you or give you notice in writing, we will do so by e-mail or by pre-paid post to the address you provide to us in your request for the App(s).
9. Events outside our control
9.1
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this EULA that is caused by any act or event beyond our reasonable control, including failure of public or private telecommunications networks (Event Outside Our Control).
9.2
If an Event Outside Our Control takes place that affects the performance of our obligations under this EULA:
(a) our obligations under this EULA will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control; an
(b) we will use our reasonable endeavours to find a solution by which our obligations under this EULA may be performed despite the Event Outside Our Control.
10. Other important terms
10.1
We may transfer our rights and obligations under this EULA to another organisation, but this will not affect your rights or our obligations under this EULA.
10.2
You may only transfer your rights or obligations under this EULA to another person if we agree in writing.
10.3
If we fail to insist that you perform any of your obligations under this EULA, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
10.4
Each of the conditions of this EULA operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining conditions will remain in full force and effect.
10.5
Please note that this EULA, its subject matter and its formation, are governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction.
This agreement has been entered into on the date of your first download of the App(s).
